NOVA Parties is committed to delivering exceptional event services. These Terms and Conditions outline the agreement between NOVA Parties and the client to ensure a smooth event experience.
By submitting payment or a retainer fee, you confirm that you have read, understood, and agreed to these Terms and Conditions.

1. Booking and Payment

Booking Definition: Securing specific services for a set time and date.

Payment Definition: The total amount required for the agreed-upon services.

Bookings are confirmed only upon receipt of full payment. NOVA Parties operates on a first-come, first-served basis and cannot hold dates without payment.

Payment Methods: Payments can be made via credit card, cash, or check (checks accepted from corporate entities only). Personal checks will not be accepted.

Non-Refundable Payments: All payments are final and non-refundable, regardless of circumstances.

Large Event Payments: For bookings exceeding $2,000, a 50% deposit is required at the time of booking, with the balance due no later than 7 days before the event. Late payments may result in cancellation without refund.

Outstanding Balances: Any balance not paid by the due date will be subject to cancellation and loss of reservation.

Additional Fees: Late payments, returned checks, or last-minute changes may incur additional fees.
Why Payments Are Non-Refundable: Upon booking, NOVA Parties reserves resources, blocks entertainer schedules, and declines other opportunities to honor your event.
2. Cancellations and Rescheduling
Rain or Shine Policy
All events are conducted rain or shine unless a state-issued State of Emergency is in effect. For weather-sensitive activities, such as foam or bubble parties, please plan for an indoor alternative.
Rescheduling Policy

Events may be rescheduled within 12 months of the original booking:

More than 2 weeks before the event: No fee for rescheduling.

Within 2 weeks of the event: A $100 rescheduling fee applies.

All rescheduling is subject to availability on a first-come, first-served basis.
Winter Weather Policy (January 1st – March 31st)

Events impacted by severe winter weather may be rescheduled without penalty.

Rescheduling requests must be made at least 12 hours prior to the event.

If a mutually agreed date cannot be determined, the payment will be retained as a credit, valid for 12 months.
Force Majeure
NOVA Parties is not responsible for cancellations or delays caused by circumstances beyond our control, including but not limited to natural disasters, pandemics, government restrictions, or transportation disruptions. Payments will be retained as credits valid for 12 months.
Client-Initiated Cancellations
If the client cancels an event:

No refunds will be provided.

Payments may be held as a credit for future services at NOVA Parties' discretion.
3. Event Requirements
Utilities and Venue

The client is responsible for confirming venue policies, securing permits, and ensuring adequate utilities (e.g., power, water).

NOVA Parties must have appropriate access to the venue for setup, performance, and breakdown.

If venue restrictions or lack of utilities prevent service delivery, payments will not be refunded.
Setup and Cleanup

NOVA Parties staff will arrive prior to the event start time to set up.

The client must ensure a safe, clean, and accessible space for services.

Equipment or props transported by the client must be returned the following day, unless otherwise agreed.
Parking and Load-In

Parking fees or restrictions at the venue are the client’s responsibility.

NOVA Parties staff must have close access for loading and unloading.
4. Client and Guest Conduct

Clients and guests are expected to treat NOVA Parties staff and equipment with respect.

Abusive behavior, harassment, or intentional damage will result in immediate termination of services without refund.

NOVA Parties entertainers are not childcare providers; children must be supervised.

The client is responsible for informing guests of potential hazards related to specific services (e.g., foam, balloons).
5. Liability and Insurance
Waiver of Liability
By booking NOVA Parties, you release, indemnify, and hold harmless NOVA Parties, its shareholders, employees, and subcontractors from all claims, suits, or actions related to injuries, damages, or losses sustained during your event.
Insurance Requirements
For large-scale or high-risk events, clients may be required to provide proof of liability insurance, naming NOVA Parties as an additional insured. This requirement will be communicated prior to booking if applicable.
6. Photography and Digital Media Release

NOVA Parties retains ownership of all designs and displays.

By booking, clients grant NOVA Parties the right to use event photos and videos for promotional purposes across all media platforms.

Clients and guests may not use or alter NOVA Parties' photos or videos for commercial purposes without written permission.
7. Service-Specific Policies
Face Painting, Glitter Tattoos, and Henna

Services are available only for participants over 36 months of age.

Artists reserve the right to refuse service to individuals with contagious conditions.

Participation is voluntary; NOVA Parties is not responsible for adverse skin reactions.
Foam and Bubble Parties
-
Participation is voluntary and at the client’s own risk.
-
Foam may cause slippery surfaces; exercise caution.
-
NOVA Parties is not liable for injuries, property damage, or allergic reactions.
Balloons
-
Balloons are 100% latex; clients are responsible for addressing latex allergies.

NOVA Parties is not liable for popped or damaged balloons post-delivery.
-
Outdoor balloon decor may be impacted by weather conditions.
No Balloon Releases
NOVA Parties will not support or participate in balloon releases due to environmental concerns.
8. Ownership of Equipment & Materials

All equipment, materials, and props are property of NOVA Parties and rented for event use.

Clients are responsible for safeguarding equipment during and after the event.

Damaged or missing equipment will result in replacement charges billed to the client.
9. Acknowledgment and Jurisdiction
Acknowledgment of Terms and Conditions
By submitting payment, the client confirms they have read, understood, and agreed to these Terms and Conditions. This acknowledgment applies whether payment is made online, via invoice, or in person. No modifications to these terms will be valid unless agreed upon in writing by NOVA Parties.
Jurisdiction Clause
This agreement is governed by the laws of the Commonwealth of Virginia. Any disputes arising under these Terms and Conditions will be resolved exclusively in the courts located in Loudoun County, Virginia.
10. Chargeback Policy
By agreeing to these Terms and Conditions, the client waives the right to initiate a chargeback for payments made in accordance with our policies. All disputes must be resolved directly with NOVA Parties.
